四川未亂天下亂，遍地開花怎麼辦？

中共建黨90周年前夕，看不到喜慶的氣氛，還沒有聽到爆竹聲，卻先傳來
槍聲、爆炸聲。除了江西撫州針對政府機關的3大爆炸，還有四川成都巴
士廠的爆炸、河南鄭州市的公安局治安支隊的爆炸、湖南耒陽一間派出所
爆炸、天津市市政府大樓附近的爆炸，可謂東西南北中，處處爆炸中。為
此，河南省下令，哪裡爆炸，哪裡的公安局長下台。
這些爆炸案還未破案，廣東又爆發兩起族群械鬥，加上其他許多地區的騷
亂，可說是遍地開花。本來，廣東是兩起單一事件：潮州一位四川農民工
向老闆追討欠薪，爭執中被老闆的人砍斷手筋、腳筋。這是一場員工與老
闆的“階級鬥爭”，結果形成四川人與當地潮州人的械鬥，當地潮州人說
不敢上街怕被打。接著廣州增城治安隊收保護費不成，腳踢一位四川孕婦
，引發四川農民工的不滿，這本來是官民衝突，結果卻又演變成為四川人
與當地人的械鬥，附近的四川老鄉聞訊趕來聲援，而當地人聲言打死四川
人不需負責。
本來，只要是一個負責任的政府，把那個老闆與治安隊員扣查嚴辦，再去
“理順群眾的情緒”就可以了。然而結果不是這樣。他們沒有“將動亂消
滅於萌芽狀態”，導致動亂擴大。主要原因當然是政府與廠方、政府與治
安隊，都屬於同一個利益集團，而外來農民工一定是弱勢族群。由於外來
農民工是弱勢族群，他們必然會抱成一團，猶如海外組織同鄉會那樣。雖
然中國不允許有官方控制不到的團體出現，但是隱秘的、結構鬆散的組織
卻難以避免，因此就有類似的地下工會與地下商會存在，藉以維護自己人
的利益。而四川外出打工的農民工最多，在廣東就有500到700萬人之多，
這次受害的都是四川人，自然一呼百應，同仇敵愾。也由於當地人一般生
活情況較農民工優裕，又歧視農民工，因此兩邊只要稍微有人煽動，就可
以演變成為族群衝突。
他們在把階級鬥爭與官民衝突轉化為廣東與四川兩大族群的鬥爭後，就可
以各打五十大板，從而讓特權利益集團脫身，這種挑動群眾鬥群眾的政治
手腕倒是令人嘆服，是共產黨最拿手的絕招。
在“槍聲、炸彈聲，殺伐聲，聲聲入耳”之際，廣東省委書記汪洋正在德
國訪問，考察當地經濟和社會管理，還沒用上就後院起火，也夠諷刺。而
重慶（大四川包括重慶與四川）市委書記薄熙來帶領“千人紅歌團”到北
京演出，藉以加強他的政治地位，但是沒有政治局常委捧場。提升社會管
理水平是茉莉花革命爆發後胡錦濤的指示，汪洋顯然是貫徹領導指示的好
幹部。而“唱紅”也是保衛紅色江山的必要，薄熙來也是共產黨的好接班
人。但是汪、薄兩人在政壇上為進入18大開展的明爭暗鬥，也是許多人都
知道的，因此這次廣東人與四川人的衝突，有沒有官方各自撐腰呢？中國
歷史上是“天下未亂蜀先亂”，如今四川未亂而天下先亂，乃因四川人權
最差，重慶則是“黑打”，使社會取得表面上的平穩，而廣東則大亂，今
後卻可能翻轉過來。而共產黨內部利益擺不平，忙於明爭暗鬥也削弱了自
己的控制力。
一般國家內部的權力鬥爭是在高層進行，不會殃及普通老百姓，但是中共
善於運動群眾，也要發動群眾來顯示自己的實力，因此中國的權力鬥爭群
眾必須站隊而捲入，這從以往的政治運動中可以看出，以文革為甚。即使
改革開放後有所收斂，六四屠殺也涉及高層權力鬥爭。如今為18大座次的
安排，各派都在摩拳擦掌，他們怎麼不會利用這些事件為自己謀取利益而
給自己的政敵難堪呢？
汪洋與薄熙來都沒有就這些事件公開發出指示與發表看法，但是很快能夠
演變成族群衝突，頗有“運籌帷幄之中，決勝千里之外”的大將風範。而
動亂沒有幾天，軍隊就出動，果然很快控制住局勢，也再次證明，只要靠
武力鎮壓，天大的事，也是小事一件。問題是事情就此了結嗎？每次只要
出動裝甲車就可以解決嗎？
清朝末年，廣東的黃花崗起義與四川的保路運動都是針對腐敗的清朝政權
，如今四川人與廣東人惡鬥，中共這個腐敗政權就可以安枕無憂嗎？

人民日報首評潮州增城騷亂

【明報專訊】中共中央機關報《人民日報》昨日首度發文，未點名地評論近期在潮州和增城發生的外來勞工與本地人衝突事件，指外來民工從農村到城市後，因風俗、觀點等造成衝突矛盾，是「社會管理的新課題」。

流動時代唱好融合大戲

《人民日報》發表以〈流動時代唱好融合大戲〉為題的署名文章，指「一些地方接連發生了本地人與外來務工人員的摩擦事件」，這些衝突既是由於人口從欠發達地區向發達地區流入後，由於風俗、觀念以及階層的差異而產生矛盾，也是戶籍制度、討薪艱難、社會歧視等因素，「給社會留下深深的裂痕」。

文章未正面提及在潮州、增城發生的騷亂，但舉了一個在廣東播出的電視劇集《外來媳婦本地郎》。劇集講述了一戶廣州人家中，嫁入了外地甚至外國的兒媳婦後，發生的一系列生活笑話。文章指該劇證明不同利益、文化的人群，可以在衝突與轉化中實現交融。

網民惡搞《建黨偉業》諷時局

劣評不斷權威電影網關閉評論

【明報專訊】雲集108位中港台明星、為中共建黨90周年製作的電影《建黨偉業》昨日在內地上畫，兩岸三地實力及偶像派明星劉燁、周迅、周潤發、劉德華、吳彥祖等均有參演，但女星湯唯戲分幾乎全被刪除，僅保留1秒畫面。該片開拍至今爭議不絕，網民紛紛藉機惡搞並喻諷當今時局。為防評分極低難看，內地權威影評網站，昨日起均暫停評分功能並禁評該片。

昨日，在內地一家電影、書籍、音樂愛好者的指標型權威網站豆瓣網（www.douban.com）電影首頁上，《建黨偉業》被放在熱門電影推薦位置，卻不似其他電影有顯示評分、評論，亦無法標註「想看」或「看過」。

九成網民評最低分

昨晨該網的截圖顯示，此前曾有775人打分，1至5星（由低至高）的評分中，多達87.9%的網民打出了1星的最低評分，2星佔5.4%，3星3.5%，4星0.9%，5星僅佔2.7%。照此推斷，以10分制算，該片的綜合評價尚不足2分。不過也有截圖顯示，該網對該片的綜合評分高達5.1分，有人直呼「豆瓣造假」。

「《建黨偉業》成為豆瓣史上第一部無法評分、無法評論、無法短評、無法推薦、無法標記看過和想看的電影。沒辦法，評分開了網站就掛了（死了）。讓你們抵制，讓你們評論，我們黨可不是好惹的！」網民「調侃」說。在另一個熱門影評網站時光網，網民亦無法對該片發表觀感。

影迷直言為「數星星」

《建黨偉業》自開拍以來一直話題不斷，影片僅「象徵性提供一點片酬」，卻有多名偶像級明星加入，如劉燁飾演的毛澤東、陳坤扮的周恩來、韓庚扮的鄧小平……就連路人甲乙也都明星演員，有影迷直言，看該片只是為「數星星」。圍繞湯唯戲分被刪、爭10億票房等話題，亦引起不小爭議。而民眾還多借電影嘲諷強調維穩、擔憂群體性事件的當局，「《建黨偉業》是一部勵志片，它講述了一個腐敗獨裁的政府終將被熱血青年推翻的故事」。

官方《環球時報》昨發表社評，稱《建黨偉業》折射中國社會的政治觀：「中國革命和建設充滿戲劇性，以及對陳腐思路的打破，有文藝創作取之不盡的素材。中國社會對國家過去的滿意程度，以及對未來預期的樂觀程度，預示了紅色文化的未來。」

指2學者「污蔑」毛澤東 5萬左派聯署公訴

【明報專訊】內地左派網站「烏有之鄉」指學者茅于軾、辛子陵「污蔑」中共開國領袖毛澤東而發起的「公訴」連署，昨天截止。據稱有全國29個省市5萬人簽名，公訴書昨天寄往全國人大和各省市人大。

聯署者包括退休高官
今年4月26日，茅于軾在內地多家網站發表《把毛澤東還原成人》一文（是內地退伍軍官辛子陵所著《紅太陽的隕落》一書的讀後感）。文中指毛澤東在位期間，大躍進餓死3000多萬人，中共建政後因政治原因死亡達5000萬人等等。
5月底，「烏有之鄉」網站發起全國「公審」茅于軾、辛子陵，指二人為「賣國賊」，並發起聯署。經半個月時間，全國29個省市，共5萬餘人簽名，其中包括原青海省長黃靜波、原化工部長秦仲達、原國家統計局長李成瑞等一批退休高官。「烏有之鄉」負責人范景剛稱，「希望人大對這一事件予以高度重視，並責成有關部門查處，來維護毛澤東主席的形象」。
茅于軾「讓他們鬧去吧」
經濟學者茅于軾昨日對本報回應稱，他無暇顧及此事，「讓他們鬧去吧。曾有律師建議我就名譽侵害反訴，但自己沒有時間，也沒精力。」而辛子陵說，「希望他們能告我，屆時法院庭審中，我會告訴他們毛澤東到底錯在哪裏。」

中共把公、檢、法系統變作鞏固政權的「專政機器」已不是新聞，但最近最高人民法院院長王勝俊提倡的所謂「調判結合、調解優先」的新把戲，將進一步加快中國司法制度的倒退，勢將嚴重打擊作為中國現代化基石的法治精神。
王院長在一個高級法官的研討班上強調人民法院應充當化解社會矛盾的先頭部隊，而司法人員應該鼓勵庭外調解，意思是說，假如對黨政機關或國營企業有怨氣的群眾接受庭外和解或「私下了結」的話，就可以大事化小，避免因為對簿公堂而製造新的矛盾。老王指出，「堅持調解優先，完全符合中國現行立法的本意，也是『和為貴』、『息訟止爭』等法律文化傳統的傳承」。

剝奪公民爭司法公正
王院長是公安出身，連法律文憑也沒有，經常被大陸法學界恥笑為「法盲大法官」，他前幾年的「法官亦是社會工作者」論已令稍微有專業精神的司法人員啼笑皆非。老王的新搞作的理論基礎是去年八月全國人大通過的「中華人民共和國人民調解法」，人大發言人強調人民調解是社會矛盾的「第一道防線」。目前全國已建立了八十五萬個「人民調解組織」，協助基層市民化解民眾之間和民眾針對黨政部門的各類糾紛。大陸媒體甚至說調解機制已成了疏導社會矛盾的「減壓閥」。
問題是中國式的庭外和解，等於剝奪了中國公民爭取司法公正的機會。大小法院都可以用「調解有利社會和諧」作為擋箭牌，不處理被認為是挑戰中共一黨專政的訴訟。「調解優先論」進一步說明中共領導層已明目張膽地宣佈在「穩定壓倒一切」的前提下，黨政部門可以有法不依。前不久北京公安局向部份「六四」事件死難者家長提出「私了」，要求家屬接受了「掩口費」後永遠放棄爭取平反「六四」與追究屠城者法律責任的權利。過去一兩年，政府部門亦向幾十萬三聚氰胺毒奶粉受害者的家屬安排「庭外調解」，目的當然是用錢來平息民眾對政府監管不力的憤怒。可憐不少「結石寶寶」家長深知法院不會處理他們的訴訟，在強權下被迫接受了卑微的補償，並放棄了公民享受法律保護的基本人權。

將無法無天完全發揮
庭外私了更是中共「和諧掉」尤其是知名度高的異議人士的最佳辦法。中共當然可以在法庭上用例如煽動顛覆政權，或洩漏國家機密等莫須有罪名重判良心知識分子、維權律師等「麻煩製造者」。但從保持長期和諧的角度看，假如公安或國安部門可以威迫利誘異議人士出國定居，或在大陸不再參與政治的話，則可大大降低國內與國外的震盪。
「調解優先」的口號進一步說明中國司法制度只為專政服務，中南海在復辟毛澤東思想的同時，連老毛最封建惡毒的「無法無天」傳統也發揮得淋漓盡致！

盡論中國：建記者黑名單　衞生部恐嚇傳媒

內地毒食品氾濫，民眾生活在恐懼之中，但當局竟諉過傳媒、記者。中國衞生部新聞宣傳中心主任毛群安表示，有關食品安全的報道產生的影響是巨大的，給國家的食品工業發展造成負面影響，衞生部正在打造一個健康的媒體報道平台，對極個別的媒體記者將建立黑名單，以打擊媒體有意誤導訊息。

緊盯傳媒　不緊盯奸商
沒聽說衞生部會建立生產毒食品的奸商黑名單，沒聽說衞生部會建立與奸商勾結的官員黑名單，如今，衞生部竟然要建立記者黑名單，如此打着保護國家食品工業的旗號，企圖抹煞傳媒在揭露毒食品、究責政府機構和官員方面的作用，實在是顛倒黑白是非！當然，衞生部可以說，打擊生產毒食品的主管機構是國家質監總局。但是，衞生部又憑甚麼管傳媒、管記者？
不管衞生部的本意為何，建立記者黑名單之舉，首先給人的感覺就是打壓那些敢言的傳媒、記者，打壓那些敢於在當局定調之前向民眾發出警示的傳媒、記者。自 2003年抗擊沙士時就出任衞生部發言人的毛群安，豈能不清楚傳媒在揭露毒食品問題上的社會功效，並不亞於披露疫情？ 2009年 11月，豬流感疫情在內地擴散之際，中國工程院院士鍾南山炮轟地方政府隱瞞死亡個案，「現在全國報告的甲流死亡病例數，我根本不信」。毛群安立即高調反駁：「說實話，他（鍾南山）所說的我也不相信。」但民眾最直接的回應是：「寧信鍾南山，不信毛群安。」
諉過傳媒、記者，是當局無能的表現，中國官員卻駕輕就熟。較早之前，國務院食品安全委員會辦公室主任張勇也曾批評傳媒誇大毒食品問題，強調中國的食品安全事件所佔比例很小。主管食品安全的官員們，目光不是緊盯製造毒食品的奸商及其在官場的保護傘，而是緊盯傳媒、記者，不是與傳媒合作加強食品安全監管，而是加強監控傳媒，豈不是寒了民眾之心、寒了記者之心？

（美）頻墜機（中國）山寨零件惹的禍？

兩年前駐伊美軍頻繁墜機，當時外界即將矛頭對準中國偽劣電子產品。當時，美國商業周刊報導，美軍大批武器系統都可能安裝假冒零件，這是導致美軍直升機在伊拉克或阿富汗墜毀的重要原因。
這篇名為「危險的假貨」的報導中還特地提到，來自中國的假冒芯片對美軍先進裝備的影響尤其嚴重。事實上，正是由於五角大樓自身國防採購程序監控存在巨大漏洞，才導致採購的不合格零部件對美軍的作戰能力構成嚴重威脅。

BBC報導，兩位參議員曾經在今年3月說，從外國進口美國的仿冒電子零件，傷害了美國國防工業以及美國的國家安全，他們並宣布就此展開調查。

路透報導說，中國駐美大使館尚未就此有評論。另外，15日早上11時半，美國國會幕僚就這個問題跟美國駐香港總領事見面。

美查假國防零件中拒發簽證

| 2 | | 美國空軍所購、用於F-15戰機的電腦微處理機，以及美國國防部飛彈防衛署的電腦硬體，都發現「山寨版」電子元件產品，危及美國武器設備。國會參院軍事委員會14日開記者會抗議中國拒發簽證，讓國會人員赴中國深圳調查仿冒電子元件產品。
參院軍事委員會主席李文(Carl Levin，民主黨，密西根州)與委員會首席共和黨議員、前共和黨總統候選人馬侃(John McCain，亞利桑納州)14日在記者會上，指美國武器設備使用假冒的電子零件情況嚴重，損及美國武器設備的性能。
李文指出，他們經過數周努力，中國駐華府大使館都不合作。國會調查員15日在美國駐香港領事館尋求協助，以進入中國。
據了解，美調查人員目前停留在港，希望能前往假冒偽劣電子產品的源頭深圳展開調查。
李文說，過去兩個多月來，他與共和黨議員馬侃都在爭取說服中國當局，同意讓美國調查人員進行一到兩天的實地調查。他說，中方要求調查人員推遲此行，一旦最終發給他們簽證，美方人員也須在中方的陪同下進行調查。李文說：「這行不通，我們不能讓別人看著我們進行調查。」
李文說，2010年1月商務部公布的一項針對國防部供應商的調查結果，400家供應商和組織，都不約而同將假冒的電子元件源頭指向中國。而美國貿易代表署的報告，則將假冒的電子元件源頭指向深圳。
馬侃則指出，假冒的電子元件也傷害合法的中國公司。因此，他希望中國認識到，追查假冒的電子元件，是符合兩個國家的利益的。

民企財務風暴由美燒至中國

自從研究機構「渾水」（Muddy Waters）上周發表報告聲稱綠森母公司嘉漢林業涉嫌造假後，越來越多在歐美上市的內地民企的誠信受到投資者質疑，慘遭基金洗倉導致股價急跌。香港文匯報報導，這股「財務風暴」開始由美國蔓延到香港，連玖龍紙業亦未能倖免。有分析擔憂，事件將進一步打擊投資者對內地民企的信心，並隨時演變成引爆中資概念股泡沫的「超級炸彈」。
報導指出，有分析指出，近年大批以中國概念作招徠的新興內地民企蜂擁赴海外上市，以美國占最多，不少市盈率高達100倍，甚至長期蝕錢也受熱捧，已經形成了所謂的「中資概念股泡沫」，近日的造假醜聞只不過是提前令泡沫爆破。據外電披露，近三個月在美國有5家中資股被除牌，另有15家被停牌，幾乎全部涉及造假帳或財務報告不符要求。

中國評論﹕南海混亂恩怨情仇／文：孫嘉業

【明報專訊】南海的緊張局勢中，美國的角色一直受人注目，一般都認為，越南、菲律賓連番挑釁的背後，是美國在背後支持，但這只是傳統的「冷戰思維」。到目前為止，除了駐菲大使說了幾句含糊其辭的話外，只有國務院反對越南軍演的聲明。至於國會議員和輿論的口水，不聽也罷。

中國外交連串微調

美國態度的這種微妙變化，背後的真正原因暫未清楚。不過，中國外交最近的連串微調似也有可尋，首先在利比亞問題上，中國的態度有所鬆動，繼駐埃及使館官員與利國反對派陣營首度公開接觸後，外交部更公開表態歡迎利國反對派代表訪問北京，聯合國安理會今日開會，討論利比亞局勢，中國罕有地派副外長翟雋專程出席，其表態引人注目；與此同時，以色列國防部長時隔10年首度訪華，亦引起國際輿論關注。特別是內地媒體引述以色列防長對以巴衝突的標題「人不犯我，我不犯人」，更是以色列近年在內地輿論中少有的正面形象；國家主席胡錦濤日前在上海合作組織峰會中會見伊朗總統時，也奉勸其加快與西方國家的對話。

歐美與中方做交易

中國外交的這種微調，雖多少有因北非茉莉花革命、拉登被殺後的政策調整成分，但肯定也是一種妥協的交易。中俄兩國雖然阻擋不了北約空襲利比亞，但卻可能是逼走卡達菲的最後國際因素；中國或許無力斡旋以巴衝突，但卻能在牽制伊朗方面扮演關鍵角色。而這一切，歐美國家都不可能不與中方在某些方面做交易。這個交易的籌碼，也許正是南海。

說回南海，爭議各方中，大馬和印尼都作壁上觀，中方表態空前溫和；菲越兩個狠角色中，前者也許算美國舊友，後者只能是個賣身投靠的「新歡」，美國難為她兩肋插刀，傳統上中國才是越南最大「靠山」；這種混亂的恩怨情仇，令各方的應對都十分謹慎小心。

　我們很早就批判過基辛格的中國外交。現在八十八歲的這位猶太裔前外交家，依然在吃老本，販賣他對美國對華政策的影響，製造他最了解中國的假象。而中國大陸人，嚐到對西方開放的好處後，也接受官方的誤導：感謝這位「打開中美關係第一人」。中共和基辛格一直都在回避四十年前的一個大陰謀：聯中反蘇。只有維基百科這樣的傳媒才不回避。
　事實非常清楚。毛晚年的獨裁和發動文革，重要的出發點是反修，即反蘇。這和美蘇冷戰完全是性質、範疇不同的兩回事。正如大陸左派所指，中國現在的「變修」何止超過當時蘇聯一百倍！「改革開放」業已證實，當年毛周聯美反蘇，才是對社會主義的真正的背叛。而且，在文革已是天怒人怨、眾叛親離的一九七二年，美國總統屈尊來訪，除了給差點被林彪氣死的毛打氣撐腰外，水深火熱的中國人，得到什麼好處？只有暴政的延續。質言之，基辛格的計謀只是利用和擴大中蘇分裂為美國謀取戰略優勢而已，哪管你民不聊生、暗無天日，更無視國際共運內部發生的深刻變化，這樣的計謀既無道德也無遠見。中國人從暴政中解脫出來，靠的是上帝而不是美帝。正是毛死（中國人說見馬克思而不是見上帝）之後，中國才逐步走上「修正主義」和對外開放之路。
　基辛格念念不忘毛周給予他的禮遇。大吹毛如何有氣魄，有哲人的智慧，改變了世界。羨慕毛讓他「體會到力量、權力和意志的共鳴。」還賣弄他那點中國歷史文化，說中國總是走在世界前列，現在只是重塑原位。構說似是而非的「東方戰略」，說韓戰及幾次邊界衝突，都是以戰爭求和平……如此拜倒在中國帝王權威面前，對中國政治的判斷，必然背離美國立國的價值觀。從譴責八九學生佔領廣場是削弱政府，妨礙開放政策，到宣稱「西方眼中的人權問題，也許不適合中國，因為傳統厚重，無法改變」。他熱烈鼓吹的是建立「美中太平洋共同體」，告誡「想教中國如何在世界上行事，都是錯誤的願望。」
　無疑的，基辛格已是中國現行體制熱烈的維護者、辯護士與代言人。中國的經濟實力又提升了他的話語權。但是，中國專制制度和全球化的衝突，更需要國際社會的監督。只有新華社才抑制不住地讚揚基老「不遺餘力地『替中國說話』」，他們不回避基辛格已和中共建立了利益共同體。據報導，基辛格的顧問公司照顧數十家大公司的中國生意。他去過中國已五十多次，大客戶給他提供私人豪華專機來回中國，「顧問費用奇高」。相信很少有政客像基辛格這樣將從政資源最大化變為商業利益。他在商界已贏得「跨國掮客」的稱號。

成一定程度的理解，否則無法解決問題。」他認為，中美兩國都有強大的諜
報能力，關鍵要坐下來談。

出席同一場合的卸任美國駐華大使洪博培（Jon Huntsman）也同意要「劃下

紅線」，訂定兩國在某些領域不可越雷池半步。

五十分的法官法（林峯正）

眾人引頸企盼超過20年的《法官法》終於完成立法。馬總統說，這是司法改革史上重要的里程碑，堅持走對的路，義無反顧。司法院賴浩敏院長也說，司法改革的基礎因此底定，具有歷史里程碑意義，像是吃了定心丸一樣。

站在民間的角度看，我們卻不作如是觀。《法官法》的立法可以算是司法改革史上的里程碑，也應該義無反顧去推動。不過，我們要問的是，這部承擔高度社會期待的法律，正式上路以後真能改善司法品質，提升人民對司法的信賴嗎？作為本法長期倡議推動者的一員，我必須誠實的說，未必。
獨立客觀一向被視為司法的靈魂，也因此《憲法》規定「法官應依據法律獨立審判」、「法官為終身職」，都清楚說明《憲法》維護審判獨立的初衷。但是，保障之所在也是弊病之所在。保障本應是達成審判獨立的手段，到頭來反倒成了目的。在現實社會中，向來只聽到司法官員在回應輿論批評時，習慣性地照本宣科告訴大家，法官的所作所為都是在維護審判獨立的憲法要求，但卻忘了司法的義務是給全民應有的公平正義。當公平正義的果實缺席或遲到時，審判獨不獨立早已不是重點。眾人要問的下一個問題是，政治民主化後的司法逐漸脫離威權黑手的掌握，開展審判獨立的空間，固值稱許。但令人猝不及防的是，超越審判獨立後的獨大、獨裁竟公然呈現在全民的面前。

自律變成保守藉口
我們警覺，過去為了杜絕權錢干預而為眾人所支持的法官自律，已逐漸變質，反而成為封閉、保守、不進步的藉口。因此，《法官法》的立法重心，也從二十年前保障審判獨立、法官自治，蛻變成為現今的資訊透明、引進他律，這是物極必反的自然律。
是以，這部以規範法官為主要目標的《法官法》，從掌理法官人事遷調、獎懲考核的人事審議委員會、接受評鑑法官申請調查的法官評鑑委員會，到最終決定不適任法官懲戒結果的職務法庭，全都設置在司法院內，尊重法官自律的需求，但卻在人事審議委員會及法官評鑑委員會納入外部代表，以資訊透明和他律來避免過度本位主義、官官相護。可議的是，以上兩機制的外部成員，不只將半數提名權交由法務部，還將最終的擇定權交給司法院長，此舉無異將就要萌芽的外部機制，又丟回官方主控的老路。其為德不卒，莫此為甚。
令人最不能接受的是，司法院在協商法案的過程絕口不願觸及職務法庭外部機制的建立，等於宣示懲戒法官的最終決定權仍要牢牢掌握在職業法官的手中，不願開設一丁點的透氣窗口。
剛剛三讀通過的《法官法》，拒絕放棄以考試方式選拔法官、拒絕清楚區隔法官與檢察官，依舊容許檢察官準用《法官法》等等，都是將應該即刻處理的問題往後推遲的作法，這都是司法改革最根本的問題，卻未能在此次立法過程勇於面對。以上都是司法改革的未爆彈、塑化劑，全民不可不慎。
整體而言，《法官法》最後通過的版本，充其量只是衝破了已住一段時間的司法套房，勉強站上改革的起跑點，是一部五十分的《法官法》。司法改革當然尚未成功，也不該鬆懈，同志一定要繼續努力。

法官為終身職，依法獨立審判不受任何干涉，各國《憲法》都這樣規定。但是在威權體制下，這條文不可能保障其獨立性，在民主時代卻很容易變為反改革的護身符。長期以來司法界死氣沉沉，司法公信力在民調中吊車尾，這次《法官法》的通過，總算為司法改革開啟一道門。

法官檢方互有心結
《法官法》在立法院一躺20多年，這是什麼意思呢？20年前解嚴，從中央到地方，政黨、國會、軍隊、情報、外交、經濟、社福、環保、文化教育各體系都接受改革洗禮，唯獨司法界例外，它撐起不受干預的《憲法》保護傘，與社會力展開長期對抗，它不只是民怨焦點，更是政治改革的死角。
司法改革和其他政治改革不同，司法界是高度專業化的行業，他們穿法袍，使用外人難以理解的法律術語，扮演現代祭司角色。他們都了解司法問題的嚴重性，但法官與檢察官互有心結，法務部與司法院有本位主義。這一群人號稱社會精英份子，卻以種種理由抗拒改革，20年來司法改革幾乎一片蒼白。
《法官法》的問題太多了，這個法不一定可以淘汰恐龍法官，何況還有奶嘴法官的問題，有人只給50分，但凡事總有一個起頭。有人認為納入外人參加評鑑，司法自我閹割，有如引清兵入關。其實，外人不是路人甲，而是學者和律師，法學知識不見得比法官差。讓不具法官身分者加入人審會，不是沒有後遺症，但是風險甚小，且可預防，對改革具有很大象徵意義。

民意衝擊開啟改革

12年前，台灣舉行第一屆民間司法會議，提出一大堆改革意見，全部束之高閣，沒有下文。司法制度與社會脫節，無法與時俱進，更難與國際接軌。在民意不斷衝擊下，好不容易通過《法官法》，但司法改革還有漫漫長路。

馬政府對簡體字好像很敏感，前天行政院指商家使用簡體字「無其必要性」，昨天馬總統把箭頭指向公務單位，還點名觀光局要把簡體字網站移除。實在做得太過火了，馬政府有意「去簡體字」，到底打什麼算盤？

只是向商機看齊
不只觀光局網站有簡體字網頁，陸委會、海基會網站也有簡體字版，很多地方政府為招攬陸客，網站、旅遊文宣品都有簡體字版，這就好像有英文、日文說明一般，一切都是向商機看齊。
這下好啦，馬總統一聲令下，要求政府所有官方文件、網站都應以正體字版本為主，政府單位理應包括地方政府和各地風景管理區，這還得了，網頁移除很簡單，但白花花銀子印出來的文宣品難道要銷毀嗎？

執行面大有問題
先不管民間甩不甩馬政府的道德勸說，公家單位如何執行就是個大問題，馬政府都想清楚了嗎？若馬總統的指示對第一線迎接陸客的地方政府沒強制力，光限制中央政府，不是很莫名其妙嗎？

也許，馬政府是擔心台灣出現太多簡體字會在大選年被作文章，乾脆先消毒，若是這樣，府院的喊話就只是假動作；如果是玩真的，鳴呼！真不知這種昧於現實的管制措施是怎麼想出來的。

糧價飆升越貧民兩年沒肉吃

通貨膨脹、糧食價格飆升，是香港以至全球的「貴」現象。窮國貧民最苦，越南一名媽媽靠拾荒養活三名女兒，一家人已兩年沒吃過肉。樂施會（ Oxfam）報告指，貧民的食物開支佔收入達 80%，他們要減少進食或吃腐爛食物過活。
越南 44歲女子武詩群，每天清早 5時就起床，搭三小時巴士到胡志明巿商業區拾荒，她三個女兒一個讀大學、一個弱智、一個患癌，丈夫收入很少。炒豆腐乾、菠菜炒蛋，已是一家四口的豐富菜餚，肉已停止食用。但越南通脹達兩位數字，一頓晚飯至少花 27,000盾（ 10.2港元），比去年高 20%。武詩群說：「我的收入不固定，唯一辦法是吃少一點。」
樂施會調查全球 17個國家 16,421人，發現 53%受訪者在過去兩年改變日常飲食，當中 39%說原因在於糧價飆升，他們有時要禁食一兩餐，甚至會買爛蛋和以前嫌棄的雞隻部位吃。西方國家都有同樣情況，美國有 55%受訪者說不再吃以前常吃的食物，當中 31%指拜糧價上漲所賜。
非洲窮國馬拉維居民甘巴說：「米和肉越來越貴。我想飲牛奶，但買不起。」 20國集團（ G20）農業部長下周將在法國開會，樂施會呼籲 G20領袖規管商品巿場，逼糧食價格下降，並阻止種植糧食的農地變成生產生物燃料。

衣?性感穿迷你裙等於引人犯罪？加拿大一名警察一句「女人應避免衣?如蕩婦」一句話，引發西方女性怒吼，由美加、歐洲到澳洲，多個大城市都有女性加入「蕩婦遊行」（ Slutwalk），抗議社會將性罪行歸咎受害人。現在怒火燃燒到亞洲保守國家印度，全印強姦率最高的新德里（ New Delhi）下月都有蕩婦遊行。

性感誘人強姦？全球蕩婦遊行

引發軒然大波的是加拿大警察聖圭內蒂（ Michael Sanguinetti），他今年 1月出席多倫多一個強姦問題研討會，一句「女人不想成為受害人，就應避免衣?如蕩婦」，令一群法律系女生火冒三丈，炮轟不夠，更在社交網 facebook和 Twitter號召蕩婦遊行。

「穿裙不等如說可以」
首次蕩婦遊行 4月在多倫多開步，原本估計只有 300人參加，結果有逾 3,000人響應。之後，美國、巴西、澳洲、荷蘭都有蕩婦遊行，英國倫敦上周六舉行的一次，多達 5,000人參加，有男有女有小孩，規模聲勢最浩大。
在蕩婦遊行中，不少女示威者打扮性感，以胸圍、迷你裙、吊帶絲襪示人。一位少女穿?緊身胸衣，胸口肌膚寫上「 slut」（蕩婦）一字，身旁女子卻穿上保守派回教婦女的罩袍──儘管她們打扮各走極端，但目的相同，就是表達女性有權穿想穿的衣服。
許多示威者手持標語，如「短裙不傷人，強姦犯才傷人」、「穿了裙子，不等如說可以」。他們還喊口號：「不管我們穿甚麼、去那裏，說『好』就是『好』，說『不』就是『不』！」
一些示威者則帶?傷痕來赴會。穿黑膠緊身胸衣的 18歲少女蘇比說：「我試過幾次在街上遭人非禮，當時我穿的比這衣服更保守。但大家即時反應，是問我當時穿甚麼，或者為甚麼獨自一人。我很討厭被迫為我的遭遇自責。」

少女號召新德里遊行
「這次遊行本可叫做反強姦遊行，但我們想挑戰社會認為女性穿得性感就是蕩婦、被侵犯是活該的想法。」發起這次遊行的 17歲少女理查森（ Anastasia Richardson）忿忿不平：「社會指摘性罪行受害人沒確保自己安全，卻不去責備施暴的犯人。社會文化把女性被侵犯，歸咎於她的衣?、行為和性史；正是這種態度，令受害人不敢報警，令強姦犯逃過制裁。」
理查森的看法，與印度 19歲少女薩巴沃相近。她最近在 fb設立專頁，號召下月在新德里蕩婦遊行。在加拿大長大、四年前回到印度的她，對新德里女性受侵犯的嚴重情況一直不滿──該市警方去年接到 489宗強姦控訴，非禮和向女性用暴力的事件更是數之不盡。「男人看女人的目光，就像看囊中物。」她說。
在新德里搞蕩婦遊行不容易，支持的只有大學生和中產。有售貨員說常在公車上被非禮，但不會去遊行。「爸媽不喜歡，這是有錢人的事，跟我無關。」但一名女出版商支持：「我希望有男士參加，希望他們明白女性連上街也害怕的感覺。」
新德里蕩婦遊行會有多成功，還是未知之數，但薩巴沃至少已成功引發關於女性安全、性別及社會階級等討論，這在印度已是小成就。

悲傷的水牛停步不前，驚恐流淚。

【人民報消息】不管人相信不相信，這件事發生了，就在香港。

據《世界新聞週刊》報導，一群工人牽著一頭水牛走進一家包裝廠內，準備將它宰殺做成牛排和燉牛肉。當他們接近屠宰房門口時，那頭悲傷的水牛突然停步不前，兩隻前腳往前跪下，眼淚也跟著撲簌簌地流了下來。那頭水牛還沒有進屠宰房，它是怎麼知道自己將要被宰殺的？這一點比人還靈。

「當我看到這種被人們認為是愚笨的動物，竟然在哭泣，以及看到它那充滿恐懼和悲哀的雙眼時，我忍不住地發起抖來。」一位受到極度震撼的屠夫 Shiu Tat-Nin回憶說。「我趕緊叫其他人過來看，他們也和我一樣地訝異！我們不住地推拉著那頭水牛，可是它卻一動也不動，只是坐在那邊不斷地哭泣。」

一位香港的包裝廠老闆Billy Fong說，「人類一直以為動物是不會像人一樣哭泣，可是那頭水牛真的像個嬰孩一樣地啜泣著！」當時至少有十幾個強壯魁梧的男士在場，他們的心被哭軟了，負責宰殺的那些男孩內心更受到觸動，眼淚也不禁奪眶而出。

水牛淚流不止。

其他的屠宰工人聞訊也都跑過來圍觀這頭哭泣下跪的水牛，現場擠得水洩不通，都被眼前的景象給震住了，其中有三個人更是當場就呆了。他們說，以後宰殺其它動物時，將永遠不會忘掉這頭淚流滿面的水牛。

到了牛也哭、人也哭的份兒上，大家心裏都很清楚，沒有一個人忍心下得了手殺它。接下來面對的問題是：如何善後。最後他們決定大家一起出錢買下這哭泣的水牛，並且送到一間佛寺，交給那些會愛護它的出家人，好讓它可以安心的度過這一輩子。

決定做出後，神奇的事又發生了：「當我們向這只水牛保證不會殺它時，它才肯移動，然後起身緊緊跟隨著我們。」

牛是如何聽懂人的話的？

Shiu說：「不管你們相信不相信，這是千真萬確的事情，雖然聽起來確實是不可思議。」

Twenty-two years ago today, several hundred students and civilians were killed by the People’s Liberation Army to suppress the pro-democracy protests in Tiananmen Square and elsewhere in China. They were shot and mowed down by tanks as Beijing’s leadership moved to end the seven-week “social chaos” that was challenging their autocratic rule.

Twenty-two years later, much has changed in China — but one thing remains the same: The callous and ruthless determination of the Chinese leadership to maintain its grip on power, to the detriment of the people in whose name they rule.

Beijing’s latest crackdown began after the “Jasmine Revolution” deposed the autocratic leaders of Tunisia and Egypt and sparked revolts in Yemen, Syria, Bahrain and Libya. Chinese human-rights lawyers, Internet bloggers and others began disappearing. The crackdown has also had an impact in Tibetan areas of Sichuan Province after protests at the Kirti Monastery and in Inner Mongolia after the death of a herder.

It is rather ridiculous, actually, to speak of “the latest crackdown,” since it is almost impossible to tell when one crackdown ends and the next one begins: akin to the endless “anti-corruption” campaigns aimed at Chinese Communist Party members. Instead, it is an almost endless cycle of political repression, interspersed with the occasional pledge to address a few grievances — pledges kept on the most superficial levels — with a little money thrown in.

Zhongnanhai’s residents seem to think that money can buy them anything — a little like the Catholic Church’s old practice of selling indulgences and ignoring the fact that such indulgences were supposed to be granted only after the sinner confessed and sought absolution and punishment for their sins. What else can one think after hearing that Chinese security officials had approached the family of a Tiananmen Square Massacre victim earlier this year about paying compensation for the death, but without offering to provide an explanation for the death or any kind of apology?

In an open letter published this week, the Tiananmen Mothers group said its members would not be bought off, nor would they settle for anything less than a public acknowledgment of the killings, adding that “the souls of those killed during June Fourth shall not be defiled.”

How galling it must be for those in Zhongnanhai that while they have been able to expunge or block any mention of the massacre from the media in China, the iconic images of the Goddess of Democracy and a lone man standing against a tank continue to inspire democracy activists the world over. Replicas of the statue can now be found in several cities, while the moment that an Egyptian man faced off against an armored water cannon vehicle in Cairo on Jan. 25 was quickly seized by the protesters there as Egypt’s “Tiananmen moment.”

Throughout history, governments worldwide have done bad things. Many continue to do so today — such as Syrian President Bashar al-Assad’s regime, which thought a 13-year-old boy was such a threat that he deserved to be shot, beaten, burned and mutilated. However, as Beijing’s leadership learned 22 years ago, and Assad’s government and others in that region are learning now, it is they who must now live in fear of their people, not the other way around. They may be able to crush, mutilate and incarcerate, but they will not be able to do so forever.

In honor of all those who were killed in the Tiananmen Massacre and those who have died in the “Arab Spring” — in honor of those such as the Tiananmen Mothers, Nobel Peace Prize laureate Liu Xiaobo (劉曉波) and so many others who refuse to go quietly into the night — in honor of the memory of those killed or imprisoned in Taiwan during the 228 Incident and the White Terror era — take a moment today to reflect upon the rights and privileges that living in a democracy conveys.

Over the past 60 years, China and Taiwan have hurled threats across the 100-mile-wide Taiwan Strait. But China’s People’s Liberation Army Chief of General Staff Chen Bingde found a new way to get Taiwan’s goat: downplay China’s threat to Taiwan.

At the first high-level military dialogue between the U.S. and China since military contact was derailed following the sale of $6 billion worth of weapons to Taiwan in January 2010, Gen. Chen denied that China had any missiles across from Taiwan, saying, “I can tell you here, responsibly, that we only have garrison deployment across from Taiwan and we do not have operational deployment, much less missiles stationed there.”

Experts and Taiwan’s Ministry of National Defense say China has more than 1,000 missiles targeted at Taiwan. While many of the missiles may not be “across from Taiwan,” they’re awfully close, as Mark Stokes, executive director of think tank Project 2049 Institute thoroughly chronicles in a recent blog post.

Taiwan’s top brass responded in kind, with Minister of National Defense Kao Hua-chu calling Gen. Chen’s statement “far from the truth.” He added, “In actuality China has been continuously increasing the number of missiles it has deployed along the coast.”

And lest anyone interpret Gen. Chen’s comments as an indication of an actual softening of China’s stance on Taiwan, the military leader also stressed that China’s position on the island hasn’t changed, and that further arms sales to Taiwan could impact U.S.-China relations.

In Taiwan’s legislature on Thursday, Lin Yu-fang, a legislator and senior member of Taiwan’s national defense committee, said Gen. Chen was “lying through his teeth.” But in an interview Friday with China Real Time, he said despite Gen. Chen’s tougher statements about the impact Taiwan arms sales have on Sino-U.S. relations, it might be possible for China and the U.S. to broker an agreement to ensure they can maintain military relations as the U.S. continues to sell weapons to Taiwan.

“Gen. Chen’s trip to the U.S. has attracted much domestic Chinese attention, so he has to say something very tough on the Taiwan issue, to appease the many nationalists there,” he said.

He added that it would be also be a significant loss of face for a Chinese representative not to bring up the matter: “The PRC (People’s Republic of China) has kept saying Taiwan is a part of China, and the U.S. has ignored the PRC and sold weapons systems…it’s kind of a humiliation to the PRC, they have to at least do something to protest.”

But Mr. Lin said it was possible the two sides might come to a “tacit understanding” to maintain a military relationship while the U.S. sells some weapons to Taiwan. He added that could mean the U.S. would delay the sale of some weapons systems like diesel submarines or new F-16 C/Ds, both of which Taiwan covets. Still, he balked at Mr. Chen’s statement that some members of U.S. congress would consider reviewing the Taiwan Relations Act, which requires the U.S. to sell defensive weapons to Taiwan.

“There could be compromise in terms of the items sold, but if it’s a compromise in terms of no more sales to Taiwan, that’s impossible….that would change the balance of power in East Asia and is not in America’s interest,” he said.

Reveling in the real Taiwan

At Taiwan’s Taoyuan International Airport, a customs agent takes my passport and eyes it suspiciously. He looks up at me, one eyebrow raised. “Why have you come to Taiwan?” he demands.

“I heard it was a beautiful place,” I reply nervously, and the official’s gaze suddenly softens. He clutches his hands to his heart and grins widely.

“We are so happy to have you here,” he says. “I hope you find it beautiful, and tell everyone where you are from how friendly we are.”

Then he stamps my documents and waves me in, beaming long after I pass through the airport doors.

Although it has something of an international reputation as “China lite,” Taiwan possesses a vibrant national identity and pride of its own. Despite (or perhaps because of) lingering Chinese, Japanese and Dutch colonial influences, the sweet-potato-shaped island has fought to express its cultural, economic and political independence, and a strong youth culture combined with the marks of more than a dozen aboriginal tribes lend it today a dynamic air of self-rediscovery.

My delight in exploring the country’s capital city, Taipei, comes after I shed any lingering dreams of pagodas and rolling rice paddies; instead, I quickly learn to love slipping through dark, dusty doorways into shops, restaurants and seemingly secret cubbyholes where cool urban natives and hip travelers go to find the real Taiwan.

That’s what I’m after on this trip: Local color in every shape and form.

Thanks to the country’s rekindled pride, “Made in Taiwan” no longer implies the cheap production of plastic novelty items. Instead, it signifies a newfound emphasis on the local designer, the unmistakably Taiwanese artisan.

Finding them, however, can be difficult. Some of Taipei’s most adventuresome and innovative producers are tucked into the city’s claustrophobic back alleys. You have to brave the many mopeds whizzing recklessly by to reach them. But the peril’s worth it.

I discover an undeniable diamond in the rough in Figure 21, a don’t-blink sliver of a leather-goods boutique hidden in one of the East District’s many unassuming corridors. Each piece here — deliberately cockeyed change purses and meticulously hand-stitched saddlebags — has a personality of its own. The buttery-warm smell of leather hangs in the air of the studio-like boutique, where rough-and-ready briefcases rest casually alongside oddball knickknacks and vintage books, as though absent-mindedly left behind on a living-room shelf.

Venturing northeast, near the Zhongshan MRT Station, I pop into another pair of local-focused shops for a quick look around — and end up losing much of an afternoon. At the quirky, minimalist Booday, I score an armload of unique, hipstery goodies, giddily browsing through stacks of chopsticks in hand-sewn pouches, off-kilter canvas bags and playfully rough-hewn jewelry. Founded by a group of friends as a design label in 2003, Booday not only produces its own line of screen-printed notebooks that sell for about $6-$10, carry-alls ($50-$76) and T-shirts ($15-$30), it also stocks and promotes local art and artists and publishes its own quarterly magazine. In the homey upstairs cafe, I can’t decide whether to munch a house-made sandwich or get lost among the stacks of CDs by Taiwanese musicians. So naturally I find time for both.

Next door to Booday is Lovely Taiwan, a not-for-profit shop focusing on aboriginal handicrafts and art from outlying villages — from intricately detailed animal statuettes (about $26) to hand-woven fabrics adorned with native patterns (about $40). At first drawn to more banal goodies such as soaps peppered with dried local herbs, I soon find myself puzzling over a set of beautiful bottles of honey- and plum-infused drinking vinegar for about $12. A sweet-and-sour favorite throughout East Asia, sipping vinegar is often served in small cups between meal courses, purportedly to aid digestion and balance your pH. Dozens of mass-produced varieties are sold in the island’s labyrinthine grocery stores, but I was pleased to find small-batch flasks to use as an unusual cocktail mixer back home.

From mid-May, when the humidity skyrockets, sunbrella-toting locals forgo the charm of the shopping alleys to duck from one mammoth air-conditioned department store to the next. While Western designers are well represented here, most of the better malls feature local producers as well; I happily skip past racks of Calvin Klein jeans for hometown hoodies by T-shirt designer ’0416.

At the Xinyi District’s not-just-books flagship Eslite Bookstore, you can meander through seven floors stocked with gorgeous tea sets, funky pillows, hi-tech gadgets and unique stationery from Taipei-based craftspeople. Of course, the books are notable, too: The stunning photographs in such regional tour books as “Taiwan Tribes Travel” by the local publisher Guide make them great souvenirs even if you don’t read Mandarin.

Department store food courts, meanwhile, offer some of Taipei’s most delicious and inexpensive bites: crave-worthy shaved ice topped with fresh fruit (tsua bing), sizzling bibimbap (rice with vegetables), made-to-order sushi, fried rice, barbecue and even the odd twist on Western food (cone-shaped pizza, submarine sandwiches stuffed with sliced fruit). Staking out a table can be stressful, but no one seems to mind my hungry hovering as I wait to pounce on a seat.

Some malls boast fantastic sit-down eateries as well. The famous xiao long bao (steamed soup dumplings) at venerable Shanghai-style chow house Din Tai Fung are worth the long wait for a table on the basement level of the Fuxing District’s Pacific SOGO department store. Huge glass windows separate hungry patrons from the dumplingistas in the kitchen, so you can watch them hand-rolling each perfect little pouch.

Classic pork dumplings arrive screaming hot, and waiting for the morsels to cool enough before sucking out the broth is a challenge. Despite the warnings on every table about proper soup-dumpling technique, my tongue wags painfully after the first bite. Once they’re cool enough, though, the soft, salty snacks disappear quickly.

Probably no comestible is as quintessentially Taiwanese as the xiaochi, or “little eats,” found at Taipei City’s night markets. Some of these nocturnal haunts are meandering collections of stalls and food carts on streets lined with clothing and record shops (such as the Times Square-like Ximending marketplace). Others are more formal structures. The oldest of these is the covered food court at Shilin, where diners have sampled the wares of more than 500 peddlers since 1910. Year-round, a crush of students, midnight noshers and hipsters fills the pleasingly run-down enclosure lined with stalls hawking deep-fried milk, oyster omelets and da chang bao xiao chang (literally “big sausage wraps small sausage” — the little sausage is pork, stuffed inside a casing made from compressed glutinous rice).

I brace myself for another culinary rite of passage: trying chou doufu (“stinky tofu”), fermented blocks of spongy bean curd often served deep-fried and topped with pickled vegetables and a gooey, bittersweet sauce. The snack’s stench varies from vendor to vendor, but its bark can mercifully be worse than the first bite. Pleasantly chewy, it has a slightly sour flavor with a pungent, mustardlike kick.

In daylight, Taipei has a run-down quality that no one would blame you for describing as dingy. Summer’s extreme humidity leaves tracks of mold on many facades. The modern, glass-fronted buildings surrounding the massive skyscraper Taipei 101 in the Xinyi District suggest a shift toward cleaner, starker development, but a trip to older parts of the city reveals hidden corners untouched by modernity.

The oldest section, Wanhua, with its winding corridors and quiet decay, offers a glimpse of the city’s bygone days. At its bustling heart is the busy Longshan Temple. I bump past a flurry of tourists, worshipers and monks selling prayer beads outside the gates to reach the controlled chaos within, where hundreds of faithful light incense and present offerings at myriad shrines to Buddha and other deities.

Students in starched uniforms are a common sight here, coming to plead for high marks on exams and good news at the end of the school term. Other visitors leave gifts of remembrance or tokens meant to assist the unlucky in love.

In the temple’s shadow is the claustrophobic artery known as Herb Alley, a hub for Chinese-medicine vendors. Pushing past loosely bundled dried roots and dried shark fins dangling from hooks, I peruse open bags of exotic dried mushrooms, fragrant rose petals and pungent tangles of ginger and ginseng.

A short walk from Herb Alley is the city’s wholesale fabric district. At its nucleus stands a crumbling two-story building crammed with textile merchants advertising silks, satins and variations on the most popular local pattern: a vibrantly colored background splayed with peonies or other bright flowers, often referred to simply as “floral cloth.” After bargaining with a vendor selling the stuff sewn into pillowcases, I snatch it up elsewhere by the yard to use as eye-catching gift wrap.

Interested in more time travel, I take a leisurely day trip to the lush tea-growing region of Maokong, which involves a breathtaking if vertigo-inducing sky-gondola ride. The mountain’s former fame as an oolong-producing region has faded, but the gondola’s slow, 25-minute climb gives you an incredible bird’s-eye view of tiny backyard vegetable gardens and temples snuggled in the dense foliage below.

Once in hilly Maokong, I have some serious hiking to do before reaching the strip of Zhinan, the main road flanked by teahouses. I settle on a teahouse high atop a ledge for the fabled tea ceremony: a way of systematically brewing and re-brewing the leaves to draw out their flavor.

There’s often a little wistful local mysticism offered while the oolong unfurls in its clay pot. “I grew up here, and moved to the city as a young man,” the tea merchant says quietly as he pours bitter green liquid into my cup. “It gets so dark here at night, some people are afraid. But I missed this place, and I came back. I’m not afraid of the mountain. It is my home; I am from here.”

Just like the steaming cup of tea before me, he is very proudly made in Taiwan.

Ai Weiwei: Sent into darkness? View Enlarged Image

China: When a great civilization can't tolerate its greatest artists, it's in decline. When a once-great civilization, trying to recover its lost heritage, arrests great artists, it can't ascend.

On April 3, Ai Weiwei, an individualistic artist who works in media from film to architecture, was detained and "disappeared" as he waited to board a flight from Beijing to Hong Kong. The net also fell on Ai's wife and staff as his Beijing studio was sealed and reportedly ransacked, his computers seized.

By this act of repression, China's despotic regime elevated Ai to a renown beyond what he already enjoyed. This, after all, was the artistic consultant behind the Beijing National Stadium, the famous Bird's Nest, built to assert Chinese global identity for the 2008 Olympics.

Understand that Ai in recent years was snarking on Twitter and elsewhere about various doings of the regime. In that Olympic year he exposed what he saw as a corruption scandal related to collapsed schools in the Sichuan earthquake.

In February, as Chinese authorities watched the Arab upheaval, online dissidents called for similar "Jasmine Rallies."

Ai wryly tweeted: "I didn't care about jasmine at first, but people who are scared by jasmine sent out information about how harmful jasmine is often, which makes me realize that jasmine is what scares them the most."

Apparently, the night-blooming scent of Ai's tweet was enough to have him sent into darkness. Presumably alive, he dwells there with myriad other dissidents, including Nobel Peace Prize winner Liu Xiaobo.

It's sometimes said that Chinese authorities needn't fear a "Jasmine Revolution" because the Middle Kingdom's staggering economic growth has made too many citizens materially comfortable and complacent.

But clearly the regime is worried as reports spill out about continuing riots in the left-behind countryside.

As Beijing bids for global glory, its political class should hearken back to the great philosopher Lao Tzu. Anticipating Jefferson by two millennia, he taught that the greatest government is the lightest government.

That would mean releasing artists and dissidents.

中國人大發言人李肇星，最近在人大記者會上公開宣布，今年中國的國防預算為人民幣六○一一億元（約九二五億美元），比去年成長了十二．七％。這個上升曲線，二十多年來幾乎每年都以兩位數成長。針對中國不斷擴大軍事費用，台灣軍方稍早予以「合理化」的解釋是，中國要與美國爭霸，勢必要這麼做，台灣則不會與中國進行軍備競賽。但，事實有這麼事不關己、雲淡風輕嗎？

答案當然是否定的。為了減緩國際對中國增加軍費的疑慮，李肇星在表述軍費的同時特別做了「澄清」：中國有限的軍事力量，完全是為了維護國家獨立、主權和領土完整，不會對任何國家構成威脅。什麼叫做維護國家主權和領土完整？這句話，對台灣來說，自熱戰、冷戰、接觸、交流到今天所謂的「和解」之局，六十多年來何曾改變、停止過？國防部長高華柱日昨在立法院表示，面對大陸第一波攻擊，國軍可以「撐」過兩星期以上等待國際奧援。所謂的國際，當然是美國，至多再加個日本，則中國─ 台灣─美國因此連成一線，中國要與美國爭霸，繞來繞去，最後終究繞不開台灣。不論從地理上的戰略位置或者是中國本位的民族主義，皆是如此。既然如此，這豈是台灣做不做軍備競賽這麼膚淺的問題？

台灣的軍方出現這種論調，是有原因的。看看最近三年馬政府提出的國防預算，就可以清楚看出端倪。二 ○○九、二○一○、二○一一年，分別是九十六億美元、九十三億美元、九十二億美元，逐年下降遞減，與中國反向操作。想必馬政府評估台灣遭到軍事攻擊的可能性業已降低，否則如何解釋其決策考量？不但如此，若以國內生產毛額（ＧＤＰ）所占比例來計算，以今年為例，國防部編列的預算包含基金等在內只有二．七％，若是直接用在國防事務的經費才只有二．一四％，距離三％愈來愈遠。三％是個具有指標性意義的數字，因為馬英九在競選時提出的國防政策白皮書上，明明白白的告訴選民：國防預算的編列將隨推動募兵制的進度而調整，原則上不低於ＧＤＰ三％。這項承諾，至今從未有一次兌現過。

當年的馬蕭白皮書，甚至批評：「民進黨執政以來，大砍國防預算，逐年降低到二○○五年度僅占ＧＤＰ二．二七％，造成兩岸軍力失衡，國防實力惡化，民心士氣軟化」，並且還提出「本黨保證執政後強化國防實力」的承諾。但是，比較扁政府在二○○八年交棒前的國防預算已經上升到一○五億美元，結果馬政府執政三年一路下滑，沒有一年超過前朝。

按照馬蕭自訂的前述標準，現在的兩岸軍力，國防實力，民心士氣又該如何形容？難怪連藍軍立委都受不了文人政客將保家衛國的嚴肅課題視為兒戲，近日公開揚言，如果明年國防預算還到不了ＧＤＰ三％就要退回重編。不過，氣歸氣，這些立法院諸公終究選擇了「護航」與「放水」，若真在意國防預算不應該受到其他預算的排擠，為什麼不及時在今年的預算審查時就矯正，卻要訴諸二○一二年呢？

有什麼樣的三軍統帥，就有什麼樣的軍方，無怪乎看到中國公布今年的軍費已經突破六千億人民幣，台灣軍方竟然會以不進行軍備競賽做為推諉，連訴諸全民支持國防的立場宣示都免了。以台灣國防預算根本不到中國一成的懸殊規模，軍方有什麼資格講軍備「競賽」？實際上，台灣國防預算的緊迫早就引起美國輿論的關切，尤其推動募兵制造成人員維持費愈來愈高，更將影響作業維持費與軍事投資的分配。做為軍人，不敢就此挺起腰桿向當局直諫，這是連基本的本份都沒做到，更不要談有些軍人是不是被「和平」的幻象沖昏了頭，或是貪生怕死失去了榮譽，已經不知為何而戰、為誰而戰了？

英國金融時報近日在專訪中詢問馬總統：是否擔心目前的經貿政策將造成台灣過度依賴中國？馬先生說：他了解跟大陸發展關係有一定風險，但這也是創造商機的機會，所以他採取平衡的作法。平衡確實是與中國互動最起碼的安全觀念，但是平衡不是靠嘴巴講就有的，馬政府的具體平衡作為在哪裡？就以談判最重要的後盾軍力而言，台灣不跟中國比，至少要跟自己比，台灣軍力的強化、武備的提昇，趕得上馬政府不斷把所有雞蛋送入中國的進度與速度嗎？

Before Ma Ying-jeou (馬英九) became Taiwan’s president in May 2008, Taiwan was regularly portrayed in China as a “troublemaker” and was the main cause of tension between China and the US. Now Taiwan has become something of a diplomatic afterthought because it no longer makes trouble. At the US-China Strategic and Economic Dialogue, indeed, Taiwan was barely mentioned, as North Korea, Iran and the value of the Chinese yuan claimed the most attention.

It has always been unfair to demonize the Taiwanese merely for wanting what most people around the world take for granted: To uphold their basic human rights and way of life, including the right to decide through a democratic process their own future.

China, however, rejects such sentiments about self-determination and, as a rising power, China is not a force that even democratic leaders dismiss lightly. For years, China’s ruling Communist Party has maintained that Taiwan is a “core national interest,” despite the reality that Taiwan has existed and functioned as a virtual state for 60 years.

The government has said it opposes a referendum on the ECFA issue. The official Web site of the Ministry of Economic Affairs (MOEA) publicly states, “there are many ways for public participation. Public meetings and public opinion polls are feasible options.” However, referendums are not the “only choice” and “considering international convention and domestic majority support for an ECFA, there is probably no need to waste national resources by organizing a referendum.”

Ma and Wu’s public statements against a referendum are too numerous to record here. The fact is that Ma has never agreed to hold a referendum on the proposed ECFA.

To counteract former president Chen Shui-bian’s (陳水扁) maneuvering for a referendum in his reelection bid in 2003, the KMT passed the Referendum Act in the Legislative Yuan setting a very high threshold for initiatiating a referendum. However, Chen found a loophole in Article 17 of the law by launching the first-ever “defensive referendum” along with the presidential election in 2004. The KMT obstructed the referendum and violated the democratic principle of people’s freedom of choice by calling for its supporters not to cast referendum ballots.

4月9日一早搭6：58高鐵趕到高院，已經有人幫我佔好位置在20名內。聽到現場有人在談論：「民進黨內部並不感激阿扁在選舉時所給的錢，因為他們認為那是本來就應該給民進黨的！」正好下午4點多，陳總統答辯時說：1996年彭明敏、謝長廷搭檔選總統時，民進黨要他倆捐出政府每票補貼的1/2，而彭謝只願付出1/3，據說當時鬧的很不愉快！陳總統怕此事再重演，所以把兩次選總統的每票補貼全部捐出，共3億2千萬。其他前前後後總共贊助民進黨候選人加起來超過13億元，加上統媒所謂的海角7億，陳總統實際已捐出三分之二的個人政治獻金給民進黨，又有誰了解？說句良心話，不來這裡旁聽，還不知道陳總統這麼值得人家尊敬。

我從3/31、4/2、4/7、4/9這四場答辯裡觀察到，民進黨真是無知又太不認真！有多位立委4/7下午4點要求進入高院旁聽，每人在裡面約待6-20分鐘，我實在不知道在這麼短的時間內，他們能聽出個什麼所以然來…？

4/7是因為陳昭姿社長拜會過民進黨，法警還問支持者：「今天是怎麼回事，來這麼多立委？」支持者很伶俐，回說：「網路流傳要阿扁們的票，要到法院旁聽！」說真的，如果他們真正有心關懷陳總統，還需要北社陳昭姿社長開記者會並到民進黨中央黨部拜會要求嗎？

4/7這天，陳總統一早被帶到法庭，一開始鄧法官說了"想休息，可以到隔壁休息室看視訊，有發言必要再過來”，陳總統昨天回答到很晚，但他要留在現場
(原來昨天下午開秘密庭，陳總統也出庭了)。

4/7這天，早上是李界木(龍潭案)ˋ郭全慶ˋ蔡明哲(郭蔡兩人是南港案)ˋ陳鎮慧這四個人的認罪，下午內容在檢座認為國務機要費是“專人專戶”，把陳鎮慧提升為國務機要費的負責人，而律師這邊以過去李登輝時代長期來的經驗認定國務機要費是“專款專用”，也就是說“只要出具領據”總統認可就直接核銷，陳鎮慧絕對不是國務機要費的專門負責人，陳鎮慧長期來是扁珍公私帳的出納。

4/7從早到晚上7點，陳總統只說了要留在現場的話，再沒其它發言`.

4/9早上，有一位鄭小姐來要求換證給立委，我當下表示我的旁聽證不出讓，鄭小姐不以為然，她認為立委出面才有力量，我反問：「民進黨立委們為陳總統做了什麼？還不如一個鄭新助！」在一旁的蔡同榮立委自始至終不發一語，他大概也不知道要說什麼吧？！

4/9整個早上都是檢察官發言，那最後一個，字句放慢，一直講到12點，連鄧法官都牢騷了幾句，接下來陳總統很專注，他先謝謝三位法官並以肯定鄧法官說過的：“只做法律判決不做政治考量”…等感言作為開頭，再以”罪刑法定ˋ證據裁判ˋ無罪推定ˋ罪宜微輕”程序答辯。早上站著講了一個鐘頭，下午繼續站著講三個鐘頭，陳總統的思緒條理分明ˋ答辯清楚易懂，令人不得不佩服他的毅力！這麼清楚交代的被告，若被判有罪，那真的是“大人冤枉啊”！

4/9當晚11：00，陳總統最後講完話，過了幾秒我大喊：「司法人權加油！」結果當然是被趕了出來！一回頭，美靜姊跟在後面，她也被請出來，因為她也喊了"請釋放陳總統"，有人對此舉動相當不諒解：「妳會影響法官的判決！」唉…台灣人就是這樣，不管做了什麼，沒成功就是不對，我不用替自己辯解，而事實上…在午飯時間，律師就透露：今天不會放人！
(李美靜小姐有美國人身分，對陳總統及其家人的每一庭，她都到場旁聽，從懷疑到變成扁迷，他說陳總統才是台灣真正的公理正義)

對於海外戶頭事件，很多人來跟我說，叫他們別匯回來，否則會變成政治籌碼，我說鄧法官在4/2講過一句話，那個錢“不是判刑的實體資料，是量刑的參考”，大家想想這句“中國話”，自由心證是什麼？民進黨因為“陳水扁”而發亮過8年，現在自己砸了這塊招牌，也難怪陳總統的家人要自求多福了！我能體會，我真的能體會！也不希望給陳致中、黃睿靚太多壓力，只要他們做的，我全都贊同！

4/2下午4-5點左右，我從廁所走出來，在要回到法庭的中途，遇到黃睿靚表示她想上廁所，但不敢進去，之前有聽說她上洗手間時曾被紅衫仔冷嘲熱諷，受到驚嚇，我直覺的反應是：裡面沒人，但她說有看到，於是我就陪她進去，民視女記者林弈岑跑來問她手機號碼並關心她身體狀況，因為只有20分鐘的休息時間，我打岔說：「對不起，讓她方便一下！」那女記者站在化妝室門口，久久不去，當然我也順勢跟睿靚講了一下記者、名嘴們在媒體上的表現及說過的話。

3/31越芳如檢察官再三強調海外戶頭一事，本來鄧法官挺客氣，要陳致中問母親的意思，但致中的律師卻說“致中可以違反母親的意思，逕自簽名”，當然我不懂律師的策略，只是覺得怪怪的，接著鄧法官的語氣轉為強硬，希望他們全力配合。

4/2越芳如又以外界批評扁案延宕太久，鄧法官說成：「希望明天就看到款項匯回來」，到晚間應該是超過10點，陳總統有點發火，引述拉法葉艦案佣金6億美元在他任內沒匯回來的內情。

4/7下午吳淑珍也再三強調，他們該做的都做了，4/1陳致中ˋ黃睿靚有到特偵組簽名，連原先堅持錢要匯到中立第三者戶頭也都放棄了，就聽你偵查組的！

四場聽下來，感覺是台灣不能有“能人”，像陳總統這種“能人”，被無腦的、貪心的人給害死，陳鎮慧、蔡明哲都轉為污點證人，從律師的口氣，他們對於污點證人並沒有很具體的承諾，但陳總統已被這些“自己人”給害慘了！

媒體說辜仲諒的2億是被扁珍勒索的不樂之捐，其實辜仲諒說的是：他沒被勒索，只是沒想到當初的樂捐，到現在竟成為 “不樂之捐”(應該是指被調查審問的不樂情緒吧)！

蔡明哲在海外跟辜成允經手的錢，有1億元的出入(吳淑珍說她只收到2億，而蔡明哲堅持是3億)，結果那1億元一審判“沒收”，對1億元不再追究。
陳總統的律師相當不以為意，措詞鏗鏘，希望鄧法官能追查這關鍵的1億元

至於陳敏薰的大華證券董事長官位及那1000萬，陳總統說他事先不清楚1000萬，而私人企業的董事長官位，總統也沒權力干涉。

很多官邸花費的事，原來是陳鎮慧問過會計長、武官依循舊例申請的，譬如賴國洲的交通罰單可以報帳ˋ陳致中的不行，李登輝所養的羊，飼料可以報帳，馬英九的馬小九飼料ˋ美容費都可以報帳，陳總統的勇哥飼料不行，沒想到李登輝可以請款報公帳的，到了陳水扁就不可以就變成貪污。換成別人當總統只要找個替死鬼就沒事了，還可以告檢察官!!!

鄧法官一直要扁律師說明國務機要費有沒有全部因公支出呢? 陳總統提到有時為出席會議，出門突然淋到雨，臨時買來擦頭髮的髮油ˋ換成乾的內衣褲竟然都列為貪污，提到西裝也被列入貪污，陳總統更是一肚子氣，他說許陽明也有西裝支出都沒事，為何他的西裝治裝費用叫貪污?！

會場內長期有兩個紅衫仔，在庭訊結束時他們會大喊：“檢察官加油”或“關到死”等話語對陳總統極盡羞辱！這四場聽下來我尊敬陳總統ˋ更佩服吳淑珍夫人，對陳總統的子女及其配偶，特別是黃睿靚我都要豎起大拇指！

坦白說，我對於媒體正義、記者良心，相當失望！…拉拉雜雜，心情很亂，昨晚回到家是清晨2：45。
